Staff Terms
These Staff Terms apply to everyone who uses a YBG Staffing staff account in the YBG Staffing app or at hire.ybgstaffing.com, applies to work events with YBG Staffing LLC ("YBG Staffing," "we," "us"), or works a shift we arrange. They add to our Terms of Service and Privacy Policy. If you have signed a separate written agreement with YBG Staffing, that agreement controls wherever it conflicts with these Staff Terms.
1. Who can join
- You must be at least [BRIAN TO CONFIRM: minimum age, e.g. 18] years old, and at least the legal age to serve alcohol where the event takes place for any position that involves alcohol service.
- You must be legally authorized to work in the United States and able to provide proof when we ask.
- The information in your profile and application must be accurate and kept up to date. We may decline or deactivate accounts with false or misleading information.
- Some positions or clients may require extra steps, such as a background check, ID verification or a food-handler or alcohol-service certification. [BRIAN TO CONFIRM: which checks or certifications YBG requires, if any]
2. Your working relationship with YBG
- [BRIAN TO CONFIRM: whether staff work as W-2 employees, as 1099 independent contractors, or both depending on the role. This section must match how YBG actually classifies and pays staff; have counsel review it.]
- Nothing in these Staff Terms guarantees any number of shifts, hours or income.
- Accepting or declining any shift is your choice. Declining an offer that you have not confirmed does not count against you.
3. Finding and confirming shifts
- YBG posts open shifts in Find Offers and may also offer shifts to you directly in Agenda.
- Tapping I'm interested tells us you are available. It is not a booking. YBG chooses who works each shift based on the client's needs, location, skills, experience and past reliability.
- You are confirmed only when the shift appears as Accepted in your Agenda, or when YBG confirms it to you in writing.
- If we ask you to be on standby or an alternate, you are confirmed only if we tell you that you have been moved to the confirmed team.
4. Attendance and No-Shows
- Failure to attend a scheduled shift (a "No Show") will result in being banned from working with us again.
- To avoid a No Show, please cancel at least 4 days before your event. Within 4 days, you are obligated to show up to the event.
- If you know you are not going to be present, notify us immediately so we can arrange a replacement.
5. Cancellations
- Cancel at least 4 days (96 hours) before your event.
- Last-minute cancellation = banned from working with us again.
6. Punctuality
- Arriving late three times will result in removal from future events.
7. Clock In/Out
- All team members are required to clock in and clock out using the YBG Staffing app for every shift. Failure to comply may result in delayed paycheck processing.
8. Location at clock in and clock out
- When you clock in, start or end a break, or clock out, the app records the server time and your device's location so YBG can confirm you are at the event. While you are clocked in and the app is open, it may also record your location every few minutes. The app never records your location when you are not clocked in to a shift.
- Each event has a check-in area around the venue. If you clock in or out outside it, the app asks for a short reason and flags the entry for YBG to review. [BRIAN TO CONFIRM: flag only (current setting) or block clock-ins outside the area]
- Clock-ins after the shift start time are automatically recorded as late.
9. Attire and appearance
- Wear the attire listed for the shift, for example white bistro, black bistro, or attire specified by the client. [BRIAN TO CONFIRM: YBG's standard uniform pieces, e.g. black pants, black non-slip shoes, and whether YBG supplies any items]
- Be clean and well groomed, and follow any additional appearance requirements the client sets.
- We may ask you for a current photo of your uniform before a shift. If you arrive out of uniform, you may be sent home without pay for that shift. [BRIAN TO CONFIRM: keep or remove "without pay", subject to wage law]
10. Conduct at events
You represent YBG Staffing and our clients at every event. You agree to:
- Follow the instructions of the YBG lead, the client and venue staff, as well as all safety, food-safety and alcohol-service rules.
- Treat guests, clients, venue staff and teammates with courtesy and respect.
- Keep personal phone use out of guest areas and to approved breaks.
- Never work under the influence of alcohol or drugs, and never drink alcohol while on duty, even if a guest offers it.
- Serve alcohol responsibly: check IDs as required, and do not serve minors or visibly intoxicated guests.
- Not accept cash tips or gifts unless the client or YBG allows it. [BRIAN TO CONFIRM: YBG's tip policy and how pooled or event tips are shared]
Harassment, discrimination, theft, violence, intoxication or serious misconduct may lead to immediate removal from the event and deactivation of your account.
11. Reliability and feedback
- When you cancel a shift in the app, YBG records the date and time and whether it was within 4 days of the shift. YBG also records No Shows and late arrivals for each shift.
- YBG keeps internal records of reliability, punctuality, attire and conduct, along with feedback from leads and clients. We use them to decide who is offered future shifts.
- You can ask YBG about feedback on your work at any time through Messages.
12. Pay
- The pay rate for each shift is shown on the shift in the app, either per hour or per shift. If anything in the app differs from what YBG confirms to you in writing, YBG's written confirmation controls.
- You are paid for confirmed shifts that you work, based on the hours recorded under section 7 (Clock In/Out).
- Pay schedule and method: [BRIAN TO CONFIRM: e.g. paid weekly or biweekly, on what day, and by direct deposit or another method]
- Overtime, breaks and meal periods follow applicable law. [BRIAN TO CONFIRM: any YBG-specific break policy]
- If you think a payment is wrong, tell YBG within [BRIAN TO CONFIRM: number of days] days so we can review it.
13. Confidential event information
- Client names, event addresses, guest information, schedules, contacts and pricing that you receive through YBG are confidential. Use them only to work your shift, and do not share them.
- Do not post photos, videos or details of an event, its guests or its venue on social media without permission from YBG and the client.
14. Working directly with YBG clients
[BRIAN TO CONFIRM: whether YBG wants a non-solicitation clause. If so, specify the period (e.g. 12 months after your last shift for that client), the scope (e.g. not accepting direct bookings for event staffing from clients YBG introduced you to), and have counsel confirm it is enforceable in Virginia and the other states where staff work. Otherwise, delete this section.]
15. Photos and media
YBG may take photos or video at events where staff appear. [BRIAN TO CONFIRM: whether YBG will use staff images in marketing; if so, whether by a separate media release or by consent in these terms, and how staff can opt out]
16. Transportation and travel
- You are responsible for getting to and from each event, and for the cost, unless YBG agrees otherwise in writing for a specific shift. This matches the travel acknowledgment in your application.
- If you drive, you must hold a valid driver's license, carry the insurance required by law, and obey traffic and parking laws. YBG does not provide vehicle insurance for staff travel.
- To the extent permitted by law, YBG Staffing is not responsible for accidents, injuries or losses that happen while you travel to or from an event. [BRIAN TO CONFIRM with counsel, especially if staff are W-2 employees]
17. Personal belongings
Keep your personal items secure. To the extent permitted by law, YBG Staffing is not responsible for personal property that is lost, stolen or damaged at events or while travelling.
18. Messages and notifications
YBG contacts you about shifts through the app (push notifications and Messages), and may also use email, text messages or phone calls. Keep your contact details current and check for shift updates, especially in the 24 hours before a shift.
19. Suspension and deactivation
YBG may ban, pause or deactivate a staff account for: a No Show or last-minute cancellation (sections 4 and 5); arriving late three times (section 6); false information; serious or repeated conduct issues; breach of confidentiality; misuse of the app; or violation of these Staff Terms. Bans are decided by YBG staff, not automatically by the app. [BRIAN TO CONFIRM: whether staff can appeal, and how]
20. Changes to these Staff Terms
We may update these Staff Terms. When we make important changes, we will let you know in the app or by email, and we may ask you to agree again before you can apply for more shifts.
21. Electronic agreement
When you tick the Staff Terms box on your application, YBG records the date and time of your agreement. Agreeing electronically has the same effect as signing on paper.
