Terms of Service

These Terms of Service ("Terms") govern your use of the YBG Staffing account site at hire.ybgstaffing.com and the YBG Staffing mobile app (together, the "Services"), operated by YBG Staffing LLC ("YBG Staffing," "we," "us"), 320 23rd St S, Arlington, VA 22202. By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Who can use the Services

You must be able to form a binding contract and give accurate information about yourself.
Client accounts are for people booking event staff for themselves or for an organization they are authorized to act for.
Staff accounts are for people who want to work events with YBG Staffing. You must meet the legal age and work-authorization requirements for the positions you apply for (for example, the minimum age to serve alcohol where the event takes place).

2. Your account

Keep your sign-in details confidential. You are responsible for activity under your account.
Keep your profile accurate and up to date. Tell us promptly if you think someone else has accessed your account.
You can delete your account at any time from the Profile tab in the app or on hire.ybgstaffing.com/account. Deleting your account removes your profile, pictures, documents, requests, application and messages, except records we must keep by law.

3. Staffing requests (clients)

A staffing request is a request for a quote, not a confirmed booking. A booking is confirmed only when YBG Staffing confirms it in writing (for example, by marking the request Confirmed in your account).
Minimum booking: every staffing request must cover at least 5 hours, measured from the event start time to the end time. Requests shorter than 5 hours cannot be submitted.
Quotes are based on the details you provide (date, location, hours, number and type of staff, duties, uniform and options such as dishwasher service). If those details change, the quote may change.
You can edit or cancel a request in your account while it is Pending. After we send a quote or confirm a booking, contact us to make changes. Cancellations, deposits, payment and other booking matters are governed by our Booking Terms and the quote or agreement for your event.

4. Applications and shifts (staff)

Submitting an application does not guarantee approval, an interview or work. YBG Staffing decides which applications to approve.
Your electronic signature on the application certifies that the information you provide is true to the best of your knowledge.
Shift offers and open shifts shown in the Services are subject to availability. Tapping "I'm interested" or accepting an offer does not guarantee the shift until YBG Staffing confirms it.
When you confirm a shift, you agree to arrive on time, prepared and in the required attire. Pay, schedules and other terms of any work are set by YBG Staffing separately, not by these Terms.

5. Messages and content you provide

You keep ownership of the content you upload (for example, pictures, résumés and messages). You give YBG Staffing permission to store and use it to operate the Services, review applications, staff events and communicate with you.
Only upload content you have the right to share. Do not upload anything unlawful, misleading, harassing, or that infringes someone else's rights.
Messages are for communication between you and the YBG Staffing team. Do not send spam or use messages for unrelated purposes.

6. Acceptable use

You agree not to: misuse or disrupt the Services; try to access accounts or data that are not yours; probe, scan or test the Services' security without permission; scrape the Services; impersonate anyone; or use the Services in violation of law.

7. Notifications

If you allow push notifications, we will send you updates about your account, requests, applications, shifts and messages. You can turn them off in your device settings.

8. Suspension and termination

We may suspend or close accounts that violate these Terms or put other users, events or YBG Staffing at risk. You may stop using the Services and delete your account at any time.

9. Disclaimers

The Services are provided "as is" and "as available." To the extent permitted by law, YBG Staffing disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free.

10. Limitation of liability

To the extent permitted by law, YBG Staffing will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of $100 or the amount you paid YBG Staffing for the Services in the 12 months before the claim. This section does not limit liability that cannot be limited by law, and it does not change the terms of any signed booking agreement.

11. Indemnity

You agree to indemnify YBG Staffing against claims arising from your misuse of the Services or your violation of these Terms, to the extent permitted by law.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Virginia, unless the law requires otherwise.

13. Changes to these Terms

We may update these Terms. If we make material changes, we will notify you in the Services or by email before they take effect. Continuing to use the Services after the changes take effect means you accept them.
